Immigration Minister Sean Fraser talks about the changes to Express Entry.

A measure allowing the immigration minister to invite Express Entry candidates based on an economic objective is close to being passed by the Canadian government.

The Senate is at this moment debating Bill C-19. If approved, it would grant the Minister of Immigration, Refugees and Citizenship Canada (IRCC) the power to select candidates for Express Entry based on their profession, language proficiency, intended country of residence, or any other factor that benefits Canada's economic objectives.

In a face-to-face interview with CIC News, Immigration Minister Sean Fraser expressed his hope that the bill would be approved by the Senate and that the additional powers would soon be put into effect. Even though Express Entry gives Canada a competitive edge, the minister acknowledged there is still potential for improvement.

The current state of [the Express Entry system] prevents us from tailoring invites to apply to the Express Entry system to suit those in-demand skills or qualifications, Fraser said. "If there are special issues that your economy is having, it may be facing in the long run," Fraser said.

"The Express Entry framework as it exists today is probably going to get individuals that probably won't be impeccably matched to the necessities of the Canadian economy in the event that you're in a circumstance where you have an overflow of applications that are across the board-specific sectors and that sector doesn't have high requirements in Canada."

Bill C-19's Express Entry amendments won't take effect unless the governor-general of Canada grants it royal assent.

Canadian immigration to have new immigration programs or pathways

Changes to Express Entry are coming, and Canada is developing a new temporary resident immigration scheme.

Canada is creating a new fast-track immigration program for international students and temporary foreign employees.

According to Sean Fraser, minister of immigration, the new program will provide temporary residents with a permanent route to citizenship. It will be comparable to, but not the same as, the Temporary Residence to Permanent Residence (TR2PR) program, which welcomed 90,000 foreign graduates and critical employees last year.

Fraser told CBC News, "We are currently evaluating the best course of action to establish a permanent pathway for temporary residents.

Fraser received the directive to "increase paths to Permanent Residence for international students and temporary foreign employees" not long after being appointed minister of immigration. Following a vote approved by the Canadian House of Commons, Fraser has 120 days to create and publish a plan to carry out these objectives.

That actually puts me under pressure to develop a plan to create this new pathway to permanent residency, not just for international students but also for temporary foreign workers, Fraser added.

By September 8, when Fraser's 120-day deadline expires, more information about the new program will be available.

Changes to Express Entry

This July, Canada will open the application process for permanent residency to participants in the Federal Skilled Worker Program (FSWP) and the Canadian Experience Class (CEC), but that's not the only change occurring.

On track to becoming legislation, Bill C-19 is currently making its way through the Senate. It will allow Immigration, Refugees, and Citizenship Canada (IRCC) the power to select individuals for Express Entry from the pool based on an economic objective, such as a job title, fluency in French, or educational background.

To choose which groups of Express Entry candidates will be invited to these draws, IRCC will be required to conduct a public consultation procedure. Additionally, IRCC is required to submit an annual report to Parliament outlining the economic objectives pursued in each case.

How to immigrate to Canada as a visitor

Studies have indicated that immigrants with Canadian experience are likely to have higher incomes and more employment opportunities in the first years after landing than those who arrived directly, even if being in Canada is not always required to be eligible for an immigration program.

The doors to many more immigration programs can be opened by Canadian education and work experience.

You must be accepted into a Designated Learning Institution (DLI) and have a study permit in order to pursue a course of study in Canada. A Post-Graduation Work Permit (PGWP), which many people use to earn Canadian work experience, may be available to you if you complete a full-time program lasting at least eight months.

To work in Canada, typically, you need a work permit. The Temporary Foreign Worker Program (TFWP) and International Mobility Program (IMP) work permits are just two of the more than 100 possibilities available. The main distinction between the two is that whereas IMP work permits are intended to serve Canada's economic, social, and cultural interests, TFWP work permits require the employers to submit a Labour Market Impact Assessment (LMIA). Because the work done by IMP work permit holders has been proved to be of great benefit to Canada or is the consequence of a reciprocal arrangement with another nation, IMP work permits are excluded from the LMIA.

How to enter the country with Express Entry?

The Federal Skilled Worker Program, Canadian Experience Class, and the Federal Skilled Trades Program all use Express Entry as their application management system. In other words, you must be qualified for at least one of these programs in order to be added to the Express Entry pool of applicants.

When you enter the pool, the IRCC's Comprehensive Ranking System is used to determine your score (CRS). Your work experience in a skilled occupation, academic experience, proficiency in an official language, age, and other economic considerations are all taken into account by the CRS. Your chances of receiving an Invitation to Apply (ITA) for Canadian permanent residence increase as your CRS points increase.

Candidates from the Express Entry pool may also get an invitation to submit an application for a province nomination through a Provincial Nominee Program (PNP). You will receive an additional 600 CRS points if you reply to the invitation and are nominated. Your receipt of an ITA in a later Express Entry draw will be effectively guaranteed by this bonus.

The ITA is essential to submit an Express Entry application for Canadian immigration. The normal processing time for a response from IRCC after receiving your ITA response is six months. BC PNP conducts draw on June 28th for General, Tech and Targeted NOCs

Draws are held by the BC PNP for both specialized and general/technical employment. British Columbia's westernmost province held a new Provincial Nominee Program draw on June 28. British Columbia held a general draw for immigration applications under its Provincial Nominee Program that included IT workers, healthcare professionals, and early childhood educators and assistants.

Through the BC PNP General Draw Including Tech Occupations and other targeted NOC, the British Columbia Provincial Nominee Program (BC PNP) welcomed 159 qualified individuals, foreign graduates, and entry-level and semi-skilled workers.

Canada needs more immigrants as there are 1 million vacancies.

The candidate will be granted a personal reference code once they have been determined to be eligible. The information gathered by the tool to determine eligibility is then transferred to the Express Entry profile using that.

In order to complete an Express Entry profile, the applicant needs specific papers, such as the results of their language exam, their NOC code, and their job title, but they are free to leave the profile at any time because the system retains the data. The individual may then come back within 60 days to finish and submit the profile.

The following documents can be used by applicants even if they are not required to be uploaded in order to submit a profile to the Express Entry system:

• A passport or other travel document;

• The results of a language test;

• A nomination from the applicant's province (if any);

• A documented job offer from a Canadian employer (if the candidate has one);

Candidates that meet the minimum point requirement for the round of invites will be invited.

An Overview: The Ontario Immigrant Nominee Program

The majority of immigrants in Canada reside in Ontario.

For those hoping to improve their chances of immigrating to Canada, the Ontario PNP offers nine options. 

198,000 new permanent residents, or roughly 49% of all new permanent residents in Canada, arrived in Ontario in 2021.

This is not surprising considering that Ontario has both Canada's largest metropolis and its greatest population. Because of Ontario's robust economy, well-established immigrant communities, and sophisticated support systems, many newcomers decided to live there.

The Ontario Immigrant Nominee Program offers nine different routes for people who want to relocate to Ontario (OINP).

A provincial nomination is what? 

The purpose of the Provincial Nominee Program (PNP) is to assist provinces in luring immigrants who can fill local labour shortages.

Candidates who fit the requirements for a particular pathway and who are nominated by a province may include this information in their application for permanent residence with Immigration, Refugees, and Citizenship Canada (IRCC). 

Why is a Provincial Nominee Program needed in Ontario? 

Ontario was the last province to implement a PNP in 2007 due to its already sizable immigrant population. The implementation of the system provided Ontario with the ability to choose people who would be a suitable fit and address workforce shortfalls as well as increased opportunities for newcomers to Canada to set up a good foundation for them financially inside the territory. With the exception of Quebec and Nunavut, each area and region in Canada runs its own PNP.

What classifications does Ontario provide?

There are four provincial nomination streams in Ontario, and there are sub-streams within each category, making a total of nine provincial immigration channels in the province.

Priority Steams for Human Capital

The Express Entry application system and the Human Capital Priority Streams work together.

If a person demonstrates an intention to settle in Ontario, they are also eligible for provincial nomination through the same streams under the Federal Skilled Worker Program (FSWP) or Canadian Experience Class (CEC).

French-speaking Skilled Workers Class

Ontario provides the French-Speaking Skilled Worker Class for persons who are fluent in both official languages. In terms of work experience, education, and evidence of finances, this program is identical to FSWP; however, applicants must also have a CLB score of 7 in French and 6 in English.

Stream for Skilled Trades

Candidates who qualify for the Federal Skilled Trades Program (FSTP) through Express Entry are also qualified for provincial nomination under the Skilled Trades stream. The National Occupational Classification (NOC) codes Minor Group 633 or Major Groups 72, 73, or 82 must be met by candidates, who must also have a minimum of one year of work experience in their trade.

Employer Job Offer Category

If Express Entry is not an option for you, you can express your interest to the province by being nominated in other categories. Only when requesting a nomination directly from the provincial government is an Expression of Interest appropriate.

An EOI informs the Ontario government that you would like to be invited to apply. If you decide to follow one of these tracks, you can only apply to OINP if you have been invited to do so.

You must fill out an attestation on the same day you submit your EOI that certifies everything in it is true and that you fit the requirements for the program you've chosen. The next step is to wait for a nomination invitation from the province. 

Employer Job Offer: Stream for Foreign Workers 

This route is intended for foreign workers who are out of the country but have a job offer from a business in Ontario. 

The position must fall within NOC codes 0, A, or B, and you must be able to show that you have either accumulated two years of work experience in the same occupation or the necessary license.

Employer Job Offer: Graduates from Other Countries

Candidates who have obtained job offers from a business in Ontario and are graduating from colleges or universities in other countries should apply to this stream. 

The position must fit into NOCs 0 or A. The following educational requirements apply:

A degree, diploma, or certificate that requires a completed degree as an admission requirement and takes at least two years to complete if you study full-time. A degree, diploma, or certificate that takes at least one year to complete if you study full-time 

Employer Job Offer: In-demand occupations 

If they have enough experience in professions where Ontario urgently needs more workers, skilled workers from Canada or overseas with experience that falls under NOC C or D may file for nomination. Depending on whether the job offer is for work inside or outside the Greater Toronto Area, the jobs vary slightly (GTA).

Anywhere in Ontario—including the Greater Toronto Area—can practice the following professions: 

•         NOC 8611 – harvesting labourers

•       NOC 9462 – industrial butchers and meat cutters, poultry preparers, and related workers

•         NOC 3413 – nurse aides, orderlies, and patient service associates

•      NOC 4412 – home support workers and related occupations, excluding housekeepers

•          NOC 8431 – general farm workers

•          NOC 8432 – nursery and greenhouse workers

•          NOC 7521 – heavy equipment operators (except crane)

•          NOC 7611 – construction trades helpers and labourers

•          NOC 7441 – residential and commercial installers and servicers

•          NOC 7511 – transport truck drivers

Only individuals with job offers outside of the GTA are eligible for these professions.

·        NOC 9536 – industrial painters, coaters, and metal finishing process operators

·        NOC 9537 – other products assemblers, finishers, and inspectors

·        NOC 9411 – machine operators, mineral and metal processing

·        NOC 9416 – metalworking and forging machine operators

·        NOC 9446 – industrial sewing machine operators

·   NOC 9461 –process control and machine operators, food, and beverage and associated products processing

·        NOC 9417 – machining tool operators

·        NOC 9523 – electronics assemblers, fabricators, inspectors, and testers

·        NOC 9526 – mechanical assemblers and inspectors

·        NOC 9418 – other metal products machine operators

·        NOC 9421 – chemical plant machine operators

Categories for Masters and PhD

The other two projects are planned exclusively for Master's and PhD graduates on from Ontario colleges who expect to stay in the area. The Master’s Graduate Stream requires finish of the program and something like one year of study at an approved Ontario college. In Ontario, PhD candidates must devote at least two years to finishing their degree. Candidates for both streams must have spent at least one year of the previous two years in Ontario.

Category for Entrepreneur

Different rules apply to the Entrepreneur Category. Candidates must file an EOI for this category as well, but if they are invited to apply, they must additionally go to a mandatory interview and sign a performance agreement. If they are accepted, they will be given a temporary work permit to enter Canada and will have 20 months to put their company plan into action and submit a final review after arriving. The applicant will be requested for identification to demonstrate their eligibility for permanent residence if they have satisfied the business conditions.

Conclusion

Over 93 percent of immigrants in Ontario remain there. This is so because PNPs like OINP are particularly effective at encouraging newcomers' economic setup while also helping the province.
